Open Carry Protected by 2nd Amendment - Ninth Circuit
That's what Hot Air is reporting. That the Ninth Circuit, a court nor normally seen as conservative, has said that open carry is protected by the 2nd Amendment.
Just damn! There's more at the link above, but this is quite a pleasant surprise.
Yes, it is - but like the referenced case on conceal carry (written by the same judge), this opinion is by 2 of 3 judges that heard it. I suspect that it will be reheard by the whole circuit, 11 judges, and overturned. I hope that it won't be - if it stands, it will help open up several anti gun states.
