Smollett Arrested

The news is everywhere.  Jessie Smollett has been indicted and arrested.  The charge, as I understand it, is Disorderly Conduct - False Filing.  It's a Class-4 felony (whatever that means).

At this point, Smollett has a presumption of innocence, although from what I've seen, his defense has a tough row to hoe.  Smollett has been very vocal in his victim-hood, and the interviews are all over the internet.  They are not going away.  Everyone has seen them.  This has been a very public item.

But, now Smollett is charged and we can draw a curtain across this whole tawdry incident.  Smollett has rights and we should let the system take care of the details.

Smollett may not be fully charged yet. At the oresser, it was announced that the fake "hate mail" he sent himself had White Powder in them. Add 2 counts of terror-related Federal charges at least. If the Justice System wants to, it can HAMMER Smollett.

IL class 4 felony means minimum 1 year in prison, max 3 years. Unless the judge deems an extended sentence suitable, in which case it can go to 6 years. Another 30 months probation.

Federal... depends on how frisky the prosecutor is feeling. If Smollett sent the letter, basic penalty for a mailed threat is 10 years and fines. BUT... sentencing guidelines apply; the judge weighs several factors in setting the sentence. Typically, it works out to a lot less than the max.

Another but: The white powder makes it a threat if the use of a biological or chemical weapon of mass destruction. Theoretically, that can run as high as life.

The side effect is that this has removed the antics in Virginia off the front page. Maybe now the Virginia governor can fully explain just how infanticide works. The Lt. Governor can explain what constitutes sexual assault. The state attorney general can talk his way out of charges of racism in his college days.
